一、量刑基准的确定

[三年以上十年以下有期徒刑的量刑基准] 抢劫一次，基准刑为有期徒刑四年。

抢劫取得财物，数额超过2000元，基准刑增加六个月;每增加数额1500元，基准刑增加六个月。

[十年以上有期徒刑、无期徒刑的量刑基准]

根据刑法第二百六十三条，有下列情形之一的，基准刑为有期徒刑十一年：

1、入户抢劫的;

2、在公共交通工具上抢劫的;

3、抢劫银行或者其他金融机构的;

4、多次抢劫或者抢劫数额巨大的;

5、抢劫致人重伤的;

6、冒充军警人员抢劫的;

7、持枪抢劫的;

8、抢劫军用物资或者抢险、救灾、救济物资的。

多次抢劫并且数额巨大的，基准刑为有期徒刑十二年。

入户抢劫并且数额巨大的，基准刑为有期徒刑十二年。

除上述情形外，同时具有两种以上刑法第二百六十三条规定的情形的，基准刑为有期徒刑十三年。

抢劫取得财物数额巨大，超过1万元以上的，每增加5万元，基准刑增加一年。

抢劫多次，次数超过6次的，基准刑增加一年;次数超过10次的，基准刑增加一年六个月。

具有以下情节的，基准刑为无期徒刑：

1、抢劫致人重伤，且造成被害人6级以上(含6级)严重伤残的;

2、抢劫致二人以上重伤的;

3、同时具有两种以上刑法第二百六十三条规定的情形的，并造成恶劣社会影响的;

4、同时具有三种以上刑法第二百六十三条规定的情形的;

5、抢劫数额达20万元以上，且同时具有刑法第二百六十三条规定的其他情形之一(不含多次)或造成恶劣社会影响的。

二、分格原则

基准刑为有期徒刑的，量刑格均为6个月。

三、量刑情节的适用

[从重情节]

1、具有下列情形之一的，可以在2-3个量刑格内从重处罚：

(1)在遭受灾害时实施抢劫的;

(2)在预防、控制突发传染病疫情等灾害期间，聚众“打砸抢”，毁坏或者抢走公私财物的首要分子，以抢劫罪论处的。

2、绑架过程中又当场劫取被害人随身携带财物，同时触犯绑架罪与抢劫罪，若择一重罪以抢劫罪论处的，可以在2-3个量刑格内从重处罚。

3、以违禁品为目标实施抢劫，劫得的违禁品达到非法持有该违禁品

应予追诉的数量标准的，可以在1-3个量刑格内从重处罚。

4、抢劫致人轻微伤的，每增加轻微伤一人，可以在1个量刑格内从重处罚;抢劫致人轻伤的，每增加一人，可以在1-2个量刑格内从重处罚;抢劫致 人伤残的，每增加一人，可以在1-3个量刑格内从重处罚。麻醉抢劫对人身体造成伤害的，每增加一人，可以在1个量刑格内从重处罚。(以上若有重叠，则选择 一个较重的幅度，不重复计算。)

(2)对受害人为未成年人、老人、残疾人等法律、法规予以特殊保护的群体实施抢劫犯罪的;

(3)驾驶机动车夺取他人财物，以抢劫罪论处的;

(4)三人以上结伙抢劫的;

(5)有预谋抢劫、流窜作案或者有其他恶劣情节的。

7、累犯，可以在2-4个量刑格内从重处罚。

[从轻、减轻情节]

1、有自首情节的，可以在2-4个量刑格内从轻处罚或者减轻处罚。犯罪事实或者犯罪嫌疑人未被司法机关发觉或者虽被发觉但犯罪嫌疑人尚未受到讯问、未被采取强制措施时主动、直接投案自首，没有其他从重情节的，一般可予减轻处罚。

2、有立功表现的，可以在1-3个量刑格内从轻处罚或者减轻处罚。有重大立功表现的，一般可以减轻处罚。

3、犯罪未遂的，可以在2-4个量刑格内从轻处罚。暴力程度较低，未造成实际损害的，一般可予减轻处罚。

4、被告人系初犯，认罪态度较好，如自愿认罪，适用简易程序或普通程序简化审，或如实供述司法机关尚未掌握的罪行，可以在1个量刑格内从轻处 罚。如供述的是同种较重余罪，一般应当在1—2个量刑格内从轻处罚。

(1)被告人主动赔偿被害人经济损失的;

(2)转化型抢劫，仅以暴力或语言相威胁的;

(3)积极预缴财产刑的。

6、具有下列情形之一的，可以在1个量刑格内从轻处罚：

(1)共同犯罪分子到案后，揭发同案犯共同犯罪事实的;

(2)被告人协助司法机关追回赃款、赃物的。

7、被告人有2个以上法定从轻、减轻情节或虽只有2个情节，其中之一为应当减轻情节的;没有其他妨碍从轻、减轻处罚情节的，可以考虑跨法定刑幅度减轻处罚或者适用免予刑事处罚，该情形应由审委会讨论决定，基层法院并需向市法院汇报，由市法院统一、平衡。

所谓暴力，是指对财物的所有人、管理人、占有人的人身实施不法的打击或强制，致使被害人不能的行为。如殴打、捆绑、伤害、禁闭等等。百利行为只是满足以印制受害人的反抗即可。

方法劫取他人财物。行为人如果没有使他人处于不知反抗或无法反抗的状态，而是借用了被人自己因患病、醉酒、熟睡或他人致使其死亡、昏迷等而不知反抗或无法反抗的状态拿走或夺取财物的，不是构成抢劫罪。

近日，秦皇岛市北戴河区检察院办理了一起盗窃案。2012年，辛某购买了一辆宝马汽车，买后时间不长就将车辆卖给了北京的李某，卖车当时只交给了李某一把车钥匙而自己手中仍留有一把。该车又经过两次转手后，卖给了被害人王某。今年4月，辛某通过其购买该车时车身安装的GPS定位系统，确定了该辆宝马车在秦皇岛市北戴河区的具体位置后，便从辽宁大连赶到当地，利用卖车时手中留有的车钥匙将宝马车连夜开回。

近日，江苏省南京市浦口警方经数天的蹲守摸排后，终于抓获了一个5人作案团伙，经审讯，民警发现这伙小偷对鱼竿进行改造后，先推开被窃家庭的窗户，以“钓鱼”的方式从窗口伸入行窃，共作案31起，盗窃笔记本电脑11台、手机23部，涉案财物10余万元。目前，嫌疑人均已被刑事拘留。
