论文题目：中西法律文化价值冲突与法律翻译补偿探讨

摘要：自20世纪80年代，法律翻译研究开始从法律语言层面向法律文化转向。由于中西法律文化的差异性，不可避免将会对处于不同法律文化背景下的两类读者造成意义真空；此外中英两类法律文本中所承载的法律体系、法律传统、民族心理等差异都可能存在语篇之外，法律文本生硬的逐字对等翻译将会造成隐形存在于源语言中的法律文化信息缺损。根据法律文本类型与功能及法律翻译的基本原则，法律翻译需保证翻译完整性并实现法律文化间的交流目的，因此译者必须采取适当的翻译策略来完整传递法律文本的文化信息。 本文将中西法律文化价值冲突放置于翻译补偿理论背景下加以考察。阐明了中西法律文化冲突主要存在于：社会制度、法律体系、法律功能、法律程序、法律文化传统、文化心理及思维方式；并分析这些文化冲突所引起的法律文化翻译缺损现象；文章提出运用翻译补偿策略来解决法律翻译中的文化损失问题，分析了八种翻译补偿策略：整合补偿与分立补偿；同类补偿与异类补偿；原位补偿与异位补偿；同步补偿与差异补偿在中西法律文化差异下的应用；旨在探讨如何使译文能够超越语言的表面形式兼顾法律文化避免法律翻译缺损。本文创新点在于将中西法律翻译中的文化冲突作为研究主体，借入翻译补偿理论于法律翻译研究，系统提出法律文化冲突下翻译补偿策略的应用。
