根据国务院《城市房屋拆迁管理条例》拆迁补偿方式有两种：

1、货币补偿;

货币补偿作为主要方式。其原因：一是货币补偿操作简单，且一次性了断，不会产生延长过渡期限、被拆迁人或使用人不能及时回迁等后续问题;二是货币补偿更方便被拆迁人选择住房，不受地点等方面的限制;三是避免因安置用房质量不好而使拆迁双方产生矛盾;四是更好地体现新《条例》的立法思想，即有条件实行货币补偿的，尽可能实行货币补偿。

采取的办法是根据被拆迁房屋的区位、用途、建筑面积等因素，以房地产市场评估的办法确定。对于货币补偿的具体办法各地有所不同，许多地方对此出台了法规或规章予以规范。

2、产权调换;

产权调换，是指拆迁人用自己建造或购买的产权房屋与被拆迁房屋进行调换产权，并按拆迁房屋的评估价和调换房屋的市场价进行结算调换差价的行为。也就是说以易地或原地再建的房屋，和被拆除房屋进行产权交换，被拆迁人失去了被拆迁房屋的产权，调换之后拥有调换房屋的产权。产权调换是房屋拆迁补偿安置的方式之一，其特点是以实物形态来体现拆迁人对被拆迁人的补偿。无论是居住房屋还是非居住房屋均可采用产权调换的方法，但排除了非公益事业房屋的附属物。

差价结算以等价交换的原则进行，实质上是结算被拆除房屋的市场评估价与调换房屋市场价的差价，多退少补。相当于先由拆迁人对被拆迁人按其房屋的评估价进行补偿，再由被拆迁人按市场价购买拆迁人提供的产权调换房屋

1、征地拆迁工作实施主体不规范

《中华人民共和国土地管理法》以下简称《土地管理法》第四十六条规定：国家征收土地的，依照法定程序批准后，由县级以上地方人民政府予以公告并组织实施。被征收土地的所有权人、使用权人应当在公告规定期限内，持土地权属证书到当地人民政府土地行政主管部门办理征地补偿登记。”这一法律条款明确规定征地拆迁工作的实施主体，只能是被征用土地所在地的县级以上地方人民政府。该人民政府的土地行政主管部门负责具体实施。

在现实的征地拆迁工作中，严格按照这一规定实施的很少，大多数情况是，由政府成立一个临时机构，有的叫开发区，有的叫工业园，也

2、征用土地公告不规范

征用土地公告是征用土地的必经程序，征用土地公告分为两种，一是征用土地公告，二是征地补偿、安置方案公告。

国土资源部发布的《征用土地公告办法》第四条规定：被征用土地所在地的市、县人民政府应当在收到征用土地方案批准文件之日起10个工作日内进行征用土地公告，该市、县人民政府土地行政主管部门负责具体实施。”

第五条规定：征用土地公告应当包括下列内容：

(一)征地批准机关、批准文号、批准时间和批准用途;

(二)被征用土地的所有权人、位置、地类和面积;

(三)征地补偿标准和农业人员安置途径;

第八条规定：征地补偿、安置方案公告应当包括下列内容：

(三)安置补助费的标准、数额、支付对象和支付方式;

(六)其他有关征地补偿、安置的具体措施。这两条规范的是征地补偿、安置方案公告的时间和内容。

在现实的征地拆迁工作中，完全按照法律、法规、规章的要求进行公告的很少。有的小项目未进行公告，有的制作了公告未张贴，有的应公告两次而只公告了一次，有的公告内容不完整，还有的在未收到征用土地方案批准文件时即发出征用土地公告。因此，公告内容缺少批准机关、批准文号和批准时间。征地不依法进行公告，违反了法定程序，剥夺了被征地农民的知情权，并将产生严重的后果。依据《征用土地公告办法》第十四条的规定，未依法进行征用土地公告的，被征地农村集体经济组织、农村村民或者其他权利人有权依法要求公告，有权拒绝办理征地补偿登记手续。未依法进行征地补偿、安置方案公告的，被征地农村集体经济组织、农村村民或者其他权利人有权依法要求公告，有权拒绝办理征地补偿、安置手续。

3、不告知听证权

《征用土地公告办法》第九条规定：被征地农村集体经济组织、农村村民或者其他权利人对征地补偿、安置方案有不同意见的或者要求举行听证会的，应当在征地补偿、安置方案公告之日起10个工作日内向有关市、县人民政府土地行政主管部门提出。”第十条规定：有关市、县人民政府土地行政主管部门应当研究被征地农村集体经济组织、农村村民或者其他权利人对征地补偿、安置方案的不同意见。对当事人要求听证的，应当举行听证会，确需修改征地补偿、安置方案的，应当依照有关法律法规和批准的征用土地方案进行修改。”

依照上述规定，被征用土地的农民对征用土地补偿、安置方案有不同意见，有权要求听证，并有时限要求。因此，征用土地的实施机关应当向被征地的农村集体经济组织、农村村民或者其他权利人交待听证权。可以在征用土地补偿、安置方案公告中告知听证权，也可以用其他方式告知听证权。但在现实的征地拆迁工作中，几乎都没有告知听证权，更谈不上举行听证会，实质上剥夺了被征地农民要求举行听证的民主权利。

4、调查工作不细致

调查核实工作差错较多：一是遗漏项目，几乎每一拆迁户都有补遗的问题。有的遗漏的项目还不少。二是适用补偿标准不准确，被征地的农民之间互相比较，如果标准算高了他不找你，如果算低了他就来找你。三是适用补偿标准随意性大、不公正，关系好的标准定得高一些。四是工作责任心不强，简单粗暴，不向拆迁户做耐心细致的思想工作，导致拆迁户产生抵触情绪。

5、补偿、安置不到位

一、房屋拆迁补偿安置合同应注意拆迁当事人及基本情况

当事人包括：

(一)拆迁人：是取得房屋拆迁许可证的单位。

(二)被拆迁人：是被拆迁房屋的所有人，即对被拆迁房屋拥有所有权的自然人或法人。

(三)房屋承租人：是与被拆迁人签有房屋租赁合同的房屋使用人，在租赁关系没有解除且房屋所有人不能对房屋承租人进行合理安置的情况下，拆迁人应与被拆迁人、承租人一起签订拆迁补偿安置协议，并对房屋承租人进行安置。

三、房屋拆迁补偿安置合同应注意补偿方式、补偿金额和补偿时间

补偿方式分为货币补偿和房屋产权调换。货币补偿，应根据被拆迁房屋的区位、用途、建筑面积等因素，以市场评估价格确定。产权调换，应按被拆迁房屋和调换房屋各自的房地产市场评估价格计算，结清产权调换的差价。

拆迁补偿是指市县级人民政府在作出征收决定之前，委托房屋征收部门对被征收的房屋拟定拆迁补偿标准并给予被拆迁人公平公正的拆迁补偿。实践中，拆迁方在房屋征收过程中为压缩拆迁成本，从中赚取高额利润，往往不能按照法律规定的标准给予被征收人合理补偿，而要实现这一非法目的，最终在与被拆迁人签订征收补偿协议时显现出来，那么对于被拆迁人来说，如何分辨拆迁补偿协议中隐藏的陷阱就显得尤为必要，以免落入拆迁方预先设下的圈套，而常见的拆迁协议陷阱无非体现在以下几方面.....

1、口头承诺陷阱

实践中，拆迁方为了达到尽快签约，实施动工的目的，在与被拆迁人进行协商谈判时，往往会开出各种极具诱惑，天花乱坠的口头承诺，而被拆迁人由于经验尚浅，往往信以为真，以为拆迁方的口头承诺会得以实现，按照拆迁方的要求签订了拆迁补偿协议，而当协议签署完毕后，拆迁方就对此决口不提，甚至矢口否认，而这时拆迁户才明白上当受骗，但也为时晚矣，所以对于拆迁方答应的补偿必须体现

2、回迁陷阱

拆迁补偿有货币补偿与产权置换之分，产权置换即保证了被拆迁人有回迁和就地安置的权利，一般在面临旧城区改造时，被拆迁人房屋所在地段会因旧城改造而升值，故很多被拆迁人面临拆迁时，往往选择原地回迁而非货币补偿。而拆迁方为了尽快签署协议，会承诺予以回迁，但往往在其拟定的拆迁协议文本中，会把回迁”的字样去掉，约定不明确，这样回迁就不能实现了，故如果选择回迁的方式补偿，必须在合同中，体现回迁的字样，安置房的位置、户型以及红线图这些都应明确标注。

另外，需要注意的是回迁的前提条件是，回迁地段要有居住用地的规划，即拆迁方在回迁地段必须拥有规划用地许可证，否则，即使在协议上约定了回迁的补偿方式，也因其不具备规划用地许可而不能实现。

3、空白协议陷阱

订空白协议之前，受到了拆迁方的蒙蔽与诱骗，很大程度上体现在口头承诺上，而被拆迁人以为拆迁方的口头承诺最终都会实现在空白协议上。

但是协议被拿走后，拆迁方的嘴脸就会暴露的一览无余，他们会在上面随意填写补偿，与之前口头承诺的拆迁补偿相差甚远，而最终被拆迁人拿到拆迁方填写完的协议后，方才恍然大悟，而这时即使去法院起诉也因为没有证据很难胜诉。

4、不留底陷阱

拆迁协议属于拆迁双方，协商谈判最终共同签署的结果，作为合同的种类之一，双方在签署完毕之后，应各持一份以证明其在拆迁协议中享有的权利义务。实践中，拆迁方会以协议要经过审批的幌子为由，骗走拆迁户签字或按手印的协议，且迟迟不返还到拆迁户手里，而一旦两份协议都被拆迁方拿走，拆迁方往往会擅自修改协议，这样就使被拆迁人的核心利益时刻处在风险之中，而且即使补偿不合理，被拆迁人也因为没有补偿协议作为证据，导致维权很难，因此拆迁户在签署完补偿协议后，必须相互交换留底，即自己必须保存一份已签订的拆迁协议。
