论文题目：语篇信息分析下的中国法律定义条款英译对比研究

摘要：法律定义条款是法律法规中不可或缺的一部分，它确定了法律术语的内涵和外延，也能够避免避免法律条文的模糊性。更重要的是，在大多数情况下定义条款限定了法律的适用范围，在整个法律中也就发挥着至关重要的角色。为了方便与国内外的外语者交流与合作，研究形式各异的中国法律定义条款的英译也就显得非常重要。不过，目前国内外还没有对定义条款汉译英的研究。为此，当前非常有必要进行研究尝试。本论文的研究目的有三个：其一，揭示中国法律定义条款及其对应英语译文在语篇信息方面有何差异；其二，阐释导致这种差异性的法律、文化和语言方面的原因；第三，基于对定义条款的对比研究总结出翻译汉语定义条款的启示。文章主要运用语篇信息分析树状模型来描写中国汉语定义条款及其英语译本的差异性。语篇信息分析主要分析定义条款的信息结构和信息单位。信息结构的分析将从垂直结构和横向结构两方面展开，而信息单位的分析将从信息内容、数量、位置和种类四方面展开。在个章节分析中，我们将阐释这些中问定义条款及其英语翻译之间的差异的原因。最后根据分析结论，一些翻译启示将会总结出来为以后翻译定义条款提高借鉴。在翻译启示中，翻译过程被分为两个步骤：识别和翻译。在翻译操作之前，定义条款的类别以及定义条款中谓语的类别需要首先识别清楚，在此定义条款分为标准定义条款和非标准定义条款，而标准定义条款又可分为含主谓语标准定义条款和含辅谓语标准定义条款。在下一步的翻译中，我们需要对这几类定义条款采取不同的翻译策略。
