刑事拘留又称先行拘留，是公安机关对于罪该逮捕的现行犯或者重大嫌疑分子在法定的紧急情况下，暂时剥夺其人身自由，收押于看守所监管的一种强制措施。

1.拘留权属于公安机关，不属于警察个人。

拘留是剥夺公民人身自由的行为，必须严格控制。办案警察和派出所没有拘留权。只有县级以上公安局才有拘留权。《刑事诉讼法》第六十四条规定： “公安机关拘留人的时候，必须出示拘留证。”

长)的签字。

警察个人无权决定拘留任何公民。

其他政府机关也无权拘留任何公民。

刑事拘留是在紧急情况下采取的强制措施，一般说检察院、法院用不到，因此检察院和法院也没有拘留权。特殊情况下，检察院、法院认为必要采取拘留时，应当提请公安机关行使居留权。

2.刑事拘留的对象必须的罪该逮捕的人。

拘留是为逮捕做准备的，对轻微犯罪不够逮捕条件的现行犯和嫌疑人不能采取刑事拘留措施。

对不构成犯罪的违法人员不能采取刑事拘留措施。

对证人不能采取拘留措施。

3.刑事拘留只有在紧急情况下才能使用。

分子，如果有下列情形之一的，可以先行拘留：

(一)正在预备犯罪、实行犯罪或者在犯罪后即时被发觉的;

(二)被害人或者在场亲眼看见的人指认他犯罪的;

(三)在身边或者住处发现有犯罪证据的;

(四)犯罪后企图自杀、逃跑或者在逃的;

(五)有毁灭、伪造证据或者串供可能的;

(六)不讲真实姓名、住址，身份不明的;

(七)有流窜作案、多次作案、结伙作案重大嫌疑的。

法定的紧急情况只有七种，后面没有“等”字，没有兜底条款。也就是说，除了这七种情况以外，其他任何情况都不能成为公安局拘留公民的理由。

4.拘留是一种临时的措施

批准逮捕公民的权力属于检察院。拘留只是对应当逮捕的人在申请批准逮捕期间采取的临时措施。

多长时间属于“临时”呢?正确答案是——三天。

我国《刑事诉讼法》规定公安机关的拘留权限为3日，特殊情况下可以延长1——4日。

拘留超过三日的必须有特殊情况，什么是特殊情况法律没有具体规定。一般理解是，正在调查取证，证据还没有拿到。

延长拘留期限需要公安局长批准。不是一定要延长4日，公安局长只能批准延长1日、2日，最多不能超过4日。

1979年修订刑事诉讼法时，代表们认可有些特殊案件，公安局在3——7天内确实无法完成调查取证任务，因此增加了一条“对流窜作案、结伙作案、多次作案的可以延长至30日”。

公安局长批准将拘留期间延长至30人，仅限于流窜作案、结伙作案、多次作案三种情况。

无论什么情况，30日满还没有取得犯罪证据的，公安机关必须放人。

公安机关任务应当逮捕报检察院批准，检察院应当在7日内作出批准或者不批准的决定。等待检察院批准期间，被拘留人继续羁押。

根据以上规定，刑事拘留没有特殊情况不得超过3日，特殊情况可以延长但不得超过30日，等待批捕时间不得超过7日。拘留期间最长为37天。

5.被拘留人必须在看守所关押

刑讯逼供等野蛮行为大都发生在看守所以外的地方。

今日看了一些报道，重庆打黑期间，被关押在打黑基地的人都把进看守所视为天堂。

今年开始实施的新《刑事诉讼法》增加了一条新规定：“拘留后，应当立即将被拘留人送看守所羁押，至迟不得超过二十四小时。”

办案警察无权将被拘留人带出看守所，拘留期间，办案警察提讯被拘留人必须在看守所进行。看守所有自己的医生，有驻看守所的检察官，被拘留人提讯前无伤，提讯后有伤，看守所拒绝接收，还会扣留提讯的警察。这对警察借拘留名义实施刑讯逼供是一种有效的限制。

6.不允许秘密抓人

《刑事诉讼法》第六十四条规定“拘留后，除有碍侦查或者无法通知的情形以外，应当把拘留的原因和羁押的处所，在二十四小时以内，通知被拘留人的家属或者他的所在单位。”

刑事诉讼法修改过程中，有人对这一规定提出异议。这一规定给了公安机关以“有碍侦查”为借口秘密抓人的权利。新《刑事诉讼法》将这一条改为“除无法通知或者涉嫌危害国家安全犯罪、恐怖活动犯罪通知可能有碍侦查的情形以外，应当在拘留后二十四小时以内，通知被拘留人的家属。有碍侦查的情形消失以后，应当立即通知被拘留人的家属。”

这一改动，将“有碍侦查”的情况限制在两类犯罪，危害国家安全犯罪和恐怖活动罪。对于其他犯罪，都不得以“有碍侦查”为借口不通知家属。

危害国家安全犯罪和恐怖活动罪的犯罪嫌疑人被拘留，也应当通知家属，只是通知家属的时间可以超过24小时，有碍侦查的情形消失以后，应当立即通知被拘留人的家属。

新《刑事诉讼法》第八十三条对原《刑事诉讼法》第六十四条的修改，是进一步限制公安机关不通知家属秘密抓人，而不是赋予公安机关秘密抓人的权力。

7.刑事拘留的法律后果

1.拘留期间排除犯罪嫌疑的，予以释放，发给释放证明;

2.确有犯罪嫌疑，但证据不足的，予以释放，改为取保候审或者监视居住，继续侦查;

3.确有犯罪嫌疑，证据充分。报检察院批准逮捕。

检察院批准逮捕的，立即逮捕。检察院不批准逮捕的，立即释放。

4.拘留错误的，由公安机关予以赔偿。

《刑事诉讼法》第六十五条 人民法院、人民检察院和公安机关对有下列情形之一的犯罪嫌疑人、被告人，可以取保候审：

(一)可能判处管制、拘役或者独立适用附加刑的;

(二)可能判处有期徒刑以上刑罚，采取取保候审不致发生社会危险性的;

司法实践中，民事案件中拒不履行生效判决、裁定是司法拘留适用最为普遍的一种情形。

行政拘留之所以把孕妇排除在外，主要是出于人道主义考虑。似乎根据一般推论，司法拘留同行政拘留一样都是在短时间内限制当事人的人身自由，故亦应当类比行政拘留而规定将包括孕妇在内的特殊对象排除在外。但目前的法律规定并非如此。为了维护法律的尊严，保障法院审判工作的顺利进行，不对特殊对象免予拘留具有现实的必要性。

排除立法因素，就现有法律法规而言，法律并没有赋予孕妇在司法拘留上的特权，这点是可以肯定的。

公安机关执行拘留对，应持县级以上公安机关签发的《拘留证》，向被拘留人出示《拘留证》，并宣布对其实行拘留。责令被拘留人在拘留证上签名或盖章。被拘留人拒绝签名或盖章的，应加以注明。执行拘留的人员在必要时，可以依法使用警械和武器。拘留时不出示拘留证，或先行拘留再补办拘留证，都是违法的。 根据《刑事诉讼法》第62条的规定，公安机关在异地执行拘留时，应当通知被拘留人所在地的公安机关，被拘留人所在地的公安机关应当予以配合。
